General Terms and Conditions

2. Scope

These General Terms and Conditions apply to all purchases made through the Maxigastro online store.

The conditions apply to:

  • Consumer customers (B2C)
  • Business customers (B2B)

Where different conditions apply to consumers and business customers, this is stated separately.

Mandatory consumer protection rights applicable in the consumer’s country of residence remain unaffected.

3. Orders

All orders are placed through the Maxigastro online store.

After placing an order, the customer will automatically receive an order acknowledgement by email.

The automatic acknowledgement only confirms that Maxigastro has received the order. It does not constitute final acceptance of the order.

A binding purchase agreement is concluded when Maxigastro has accepted and started processing the order.

Maxigastro reserves the right to refuse or cancel an order if:

  • The product is no longer available
  • The manufacturer has discontinued the product
  • The price is incorrect
  • A technical or system error has occurred
  • Product information is incorrect
  • Payment cannot be authorised
  • There is reasonable suspicion of fraud or misuse

If an order is cancelled, any amount already paid will be refunded without undue delay.

4. Products

Maxigastro sells, among other products:

  • Wine coolers and wine cabinets
  • Refrigerators
  • Freezers
  • Refrigerated counters
  • Display refrigerators
  • Bar equipment
  • Dishwashers
  • Professional catering equipment
  • Accessories
  • Spare parts

A substantial part of our product range is manufactured or ordered from the supplier only after the customer’s order has been received.

Delivery times may therefore vary depending on the manufacturer’s production schedule and stock availability.

5. Product Information

Maxigastro makes reasonable efforts to ensure that all information on the website is accurate and up to date.

However, we reserve the right to make changes to, among other things:

  • Technical specifications
  • Dimensions and weight
  • Energy labelling
  • Capacity
  • Materials
  • Colours
  • Product images
  • Accessories
  • Manufacturer specifications

Product images are for illustrative purposes and may differ from the delivered product.

Manufacturers may change product specifications without prior notice.

Such changes do not entitle the customer to compensation or cancellation unless the change is material.

6. Prices

Prices are displayed in the currency selected for the relevant market.

Prices offered to consumers include VAT where applicable, unless otherwise stated.

Prices offered to business customers may be displayed excluding VAT where clearly indicated.

Shipping costs, environmental charges and any other applicable fees will be displayed before the order is completed.

Maxigastro may change its prices at any time without prior notice.

The price displayed when the order is placed will apply, subject to obvious pricing or technical errors.

7. Pricing and System Errors

Maxigastro reserves the right to correct:

  • Pricing errors
  • Typographical errors
  • Printing errors
  • Technical errors
  • System errors
  • Stock errors
  • Supplier errors

If a price is obviously and materially different from the product’s normal market price, Maxigastro is not required to supply the product at the incorrect price.

The customer will be contacted and given the option to:

  • Accept the correct price, or
  • Cancel the order

Any payment already received will be refunded without undue delay.

8. Payment

Maxigastro accepts the payment methods displayed in the online store and during checkout.

Payment will normally be captured when the product is dispatched, unless otherwise required by the selected payment method, the nature of the order or applicable law.

For special-order, custom-made or customer-configured products, Maxigastro may require full or partial payment in advance.

Failure to make the required payment may result in cancellation of the order.

9. Delivery

Delivery will be made to the address provided by the customer when placing the order.

Deliveries are carried out by independent transport companies.

The estimated delivery time is displayed on the relevant product page.

All delivery times are estimates.

Delays may arise due to:

  • Manufacturer production times
  • Shortages of raw materials
  • Transportation conditions
  • Customs clearance
  • Force majeure
  • Circumstances affecting suppliers or subcontractors

Maxigastro is not responsible for delays caused by circumstances outside its reasonable control, subject to mandatory consumer law.

The customer will be informed as soon as reasonably possible in the event of a significant delay.

10. Receipt of Goods

The customer must inspect the goods upon delivery.

Visible transport damage should be recorded on the consignment note or electronic delivery receipt.

If the packaging is damaged, we recommend taking photographs before opening it.

If the damage is substantial, the customer should refuse delivery. Alternatively, the goods should be accepted with reservation, and the driver should record that the shipment was received subject to visible transport damage.

Visible and concealed transport damage must be reported to Maxigastro in writing within 24 hours of delivery.

Reports should be sent to mail@maxigastro.com and include:

  • Order number
  • Photographs of the packaging
  • Photographs of the damage
  • A description of the damage
  • A photograph of the shipping label where possible

For consumers, failure to report damage within 24 hours does not remove or restrict mandatory statutory rights. However, delayed notification may make it more difficult to investigate the damage and pursue a claim against the carrier.

For business customers, failure to report transport damage within 24 hours, or acceptance of visibly damaged goods without reservation, may result in rejection of the claim if this has impaired Maxigastro’s ability to pursue the carrier.

11. Failed Delivery or Non-Collection

If the customer is unavailable to receive the delivery, fails to collect the goods or refuses delivery without a valid reason, Maxigastro may charge the actual costs of:

  • Return transport
  • Redelivery
  • Storage
  • Handling

Additional documented costs may be charged to business customers where permitted by law.

12. Transfer of Risk

For consumer purchases, the risk passes when the goods have been delivered to the consumer or to a third party designated by the consumer, other than the carrier.

For business purchases, the risk passes in accordance with the agreed delivery terms.

13. Retention of Title

For business purchases, all supplied goods remain the property of Maxigastro until the full purchase price, including interest, fees and other applicable costs, has been paid.

Until full payment has been received, the customer may not pledge, sell or otherwise dispose of the goods in a manner that prejudices Maxigastro’s ownership rights.

14. Installation

Many Maxigastro products require correct professional installation to operate safely and as intended.

Installation must be performed in accordance with:

  • The manufacturer’s instructions
  • Applicable local laws
  • Electrical, plumbing, ventilation and safety requirements
  • Any requirements concerning authorised installers

The customer is responsible for ensuring that a qualified or authorised professional is used where required.

Defects or damage caused by incorrect installation, inadequate maintenance or use contrary to the manufacturer’s instructions are not covered by warranty or legal guarantee rights, unless mandatory law provides otherwise.

15. Custom-Made and Custom-Configured Products

Certain products are manufactured or configured only after the customer places an order and are produced specifically for that order.

These products may include:

  • Enofrigo wine cabinets
  • Custom-built refrigeration solutions
  • Products with individual dimensions
  • Products with special colours or materials
  • Products with customised glass, door or interior solutions
  • Other products manufactured or assembled according to customer specifications

Production or ordering from the manufacturer begins after the order has been confirmed.

Products manufactured according to a consumer’s specifications or clearly personalised may be excluded from the statutory right of withdrawal. This exception is recognised under EU consumer legislation.

Where this exception applies, it will be clearly stated on the relevant product page.

This does not affect the customer’s statutory rights concerning defective or non-conforming goods.

Consumer Customers (B2C)

16. Right of Withdrawal

Consumers generally have a 14-day right of withdrawal.

The withdrawal period expires 14 days after the day on which:

  • The consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods, or
  • The final product is received where several products from one order are delivered separately

To exercise the right of withdrawal, the consumer must provide Maxigastro with a clear and unambiguous statement before the withdrawal period expires.

The consumer may use the statutory model withdrawal form, but this is not mandatory.

17. Returning Goods

After notifying Maxigastro of the withdrawal, the consumer must return the goods no later than 14 days after giving notice.

The goods must be securely packaged for transportation.

We recommend using the original packaging because it is designed to protect the product during transport.

The absence of original packaging does not automatically remove the right of withdrawal. However, the consumer may be responsible for damage or loss in value resulting from inadequate packaging.

18. Return Costs

The consumer is responsible for the direct costs of returning the goods.

For large or heavy products that cannot be returned using a standard parcel service, the consumer must pay the actual cost of return transportation.

Return costs depend on factors including:

  • Product dimensions
  • Product weight
  • Collection address
  • Delivery destination
  • Carrier charges

Maxigastro may assist with arranging return transport at the consumer’s expense.

19. Condition of Returned Goods

The consumer is only liable for a reduction in the value of the goods resulting from handling beyond what is necessary to establish their:

  • Nature
  • Characteristics
  • Functionality

The product may be inspected in the same manner as would normally be permitted in a physical store.

If the product has been put into actual use, damaged or handled beyond what is necessary for inspection, Maxigastro may deduct the resulting reduction in value from the refund.

20. Refunds

Following a valid withdrawal, Maxigastro will refund payments received from the consumer, including the cost of the least expensive standard delivery method offered.

The refund will be made without undue delay and no later than 14 days after Maxigastro receives the consumer’s withdrawal notice.

Maxigastro may withhold the refund until:

  • The returned goods have been received, or
  • The consumer has provided evidence that the goods have been returned

whichever occurs first.

The refund will be made using the same payment method used for the original transaction unless otherwise agreed.

21. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where a statutory exception applies.

This includes products that:

  • Are manufactured according to the customer’s specifications
  • Are produced or assembled according to individual requirements
  • Are clearly personalised
  • Are configured specifically for the individual customer

Examples may include:

  • Custom-configured Enofrigo wine cabinets
  • Custom-built refrigeration solutions
  • Products with individual dimensions
  • Products with special colours
  • Products with customised glass
  • Products with individually selected interiors
  • Products with customer-specific technical options

The exception for goods made to the consumer’s specifications or clearly personalised is set out in EU consumer law.

The relevant product page will clearly state where a product is excluded from the right of withdrawal.

This exception does not limit statutory rights regarding defective or non-conforming goods.

22. Statutory Legal Guarantee

Consumers have a minimum two-year legal guarantee for new goods purchased from a professional seller within the EU. National legislation may provide additional rights.

The legal guarantee covers defects or non-conformities that existed when the goods were delivered.

The consumer must notify Maxigastro within a reasonable time after discovering the defect, subject to the mandatory rules applicable in the consumer’s country.

23. Exclusions from the Legal Guarantee

The legal guarantee does not cover defects or damage caused by:

  • Incorrect installation
  • Insufficient maintenance
  • Incorrect cleaning
  • Limescale
  • Frost damage
  • Electrical surges
  • Incorrect electrical connection
  • Improper use
  • Overloading
  • Use contrary to the manufacturer’s instructions
  • Unauthorised repairs or modifications
  • Normal wear and tear
  • Cosmetic changes resulting from ordinary use

These exclusions apply only where the relevant circumstance caused or contributed to the defect.

24. Processing Consumer Claims

When processing a claim, Maxigastro may request:

  • Order number
  • Product serial number
  • Photographs
  • Video documentation
  • A description of the defect
  • Information about installation and use

Where necessary, Maxigastro may require the product to be returned or inspected.

If the claim is valid, Maxigastro will cover reasonable and necessary return or transport costs in accordance with applicable consumer law.

25. Remedies

If a consumer claim is valid, the available remedy may include:

  • Repair
  • Replacement
  • A proportionate price reduction
  • Termination of the purchase and refund

The remedy will be determined in accordance with applicable mandatory consumer legislation.

26. Transport Damage

If goods have been damaged during transportation, the consumer should:

  • Record the damage at the time of delivery
  • Take photographs of the packaging and product
  • Keep the packaging
  • Contact Maxigastro as soon as possible
  • Refuse delivery or accept with written reservation where the damage is visible

These recommendations do not restrict the consumer’s mandatory statutory rights.

27. Consumer Complaints

Consumers should first submit their complaint directly to Maxigastro.

If the matter cannot be resolved, consumers in Denmark may submit an eligible complaint through the Danish consumer complaints system operated through Nævnenes Hus.

A consumer must generally first complain directly to the seller before proceeding with a formal consumer complaint.

Consumers residing in another EU or EEA country may contact the relevant consumer dispute resolution body or European Consumer Centre in their country.

The former European Online Dispute Resolution platform is no longer available. It was discontinued in July 2025.

Business Customers (B2B)

28. Scope of the B2B Conditions

This section applies to purchases made by:

  • Businesses
  • Public authorities
  • Municipalities
  • Regions
  • Institutions
  • Associations
  • Foundations
  • Other legal entities
  • Individuals acting primarily for commercial or professional purposes

Business purchases are not covered by consumer withdrawal legislation.

Business purchases are governed by Danish commercial sales law and these General Terms and Conditions.

29. No Right of Withdrawal

Business customers have no statutory or contractual right of withdrawal unless otherwise agreed in writing.

Once an order has been accepted by Maxigastro, it is binding.

Returns are only accepted with Maxigastro’s prior written approval.

30. Returns

If Maxigastro accepts the return of a non-defective product, the product must:

  • Be unused
  • Be complete
  • Be in its original, undamaged packaging
  • Be free from marks, scratches and damage
  • Be suitable for resale as new

Maxigastro may reject the return if these conditions are not met.

31. Restocking Fee

Approved B2B returns are subject to a restocking fee of:

15% of the purchase price, subject to a minimum fee of DKK 500 excluding VAT.

The fee covers, among other things:

  • Inspection
  • Handling
  • Administration
  • Restocking

Original shipping costs are non-refundable.

32. Return Shipping

Return shipping is paid by the business customer.

If Maxigastro arranges return transportation, the cost will be invoiced separately or deducted from any refund.

If the customer arranges transportation, this is carried out at the customer’s expense and risk.

33. Special-Order Products

Products manufactured, configured or ordered specifically for the business customer cannot be returned.

This includes:

  • Enofrigo wine cabinets
  • Custom-configured products
  • Products with individual dimensions
  • Products with customised glass
  • Products with special colours
  • Products with customer-specific technical solutions
  • Products manufactured or ordered specifically for the customer

Once production or the supplier order has commenced, the order cannot be cancelled.

34. Commercial Warranty

For business purchases, Maxigastro provides:

A 12-month spare-parts warranty.

The warranty period begins on the delivery date.

The warranty covers the supply of replacement spare parts only.

35. Items Not Covered by the B2B Warranty

The B2B warranty does not cover:

  • Labour
  • Service visits
  • Removal
  • Installation
  • Travel costs
  • Transportation
  • Replacement work
  • Diagnostics
  • Programming
  • Calibration
  • Adjustment or commissioning

The customer is responsible for all costs associated with diagnosing the fault and installing or replacing spare parts.

36. Loss of Warranty Coverage

Warranty coverage may be refused where the defect or damage results from:

  • Incorrect installation
  • Improper use
  • Failure to follow the manufacturer’s instructions
  • Alterations to the product
  • Use of non-original spare parts
  • Repairs performed by unauthorised persons
  • Electrical surges
  • Frost damage
  • Inadequate maintenance
  • Incorrect cleaning
  • Limescale
  • Overloading

37. B2B Claims

The customer must notify Maxigastro without undue delay after discovering a defect.

Maxigastro may require:

  • Order number
  • Serial number
  • Photographs
  • Video documentation
  • Description of the defect
  • Installation details
  • Details of maintenance and use

Processing of the claim may be suspended until the required documentation has been provided.

38. Inspection of Products

Maxigastro may require the product to be returned or made available for inspection.

If the claim is found to be invalid, the customer may be charged for:

  • Diagnostics
  • Testing
  • Labour
  • Transportation
  • Administration

39. Spare Parts

Spare parts are supplied subject to the manufacturer’s availability.

The supply or replacement of a spare part does not commence a new warranty period.

The original warranty period is not automatically extended by the replacement of a spare part.

40. Installation

All installation costs are the responsibility of the business customer.

Where the manufacturer or applicable legislation requires authorised installation, the customer is responsible for complying with this requirement.

Defects caused by incorrect installation are not covered by the commercial warranty.

41. Limitation of Liability

To the fullest extent permitted by law, Maxigastro’s total contractual liability to a business customer is limited to the invoiced purchase price of the product giving rise to the claim.

This limitation does not apply where liability cannot legally be excluded or limited.

42. Business Interruption and Indirect Loss

To the fullest extent permitted by law, Maxigastro is not liable to business customers for:

  • Business interruption
  • Production loss
  • Lost revenue
  • Lost margins
  • Lost profit
  • Lost contribution margin
  • Loss of data
  • Indirect loss
  • Consequential damage
  • Claims or expenses incurred by third parties

This applies regardless of the basis of liability, except where liability cannot legally be excluded.

43. Delivery Delays for Business Customers

Delivery times are estimates unless expressly confirmed as binding in writing.

A delay does not entitle a business customer to:

  • Compensation
  • Penalties
  • A price reduction
  • Cancellation

unless otherwise agreed in writing or required by mandatory law.

44. Force Majeure

Maxigastro is not liable for failure or delay in performing its obligations where caused by circumstances outside its reasonable control.

Such circumstances may include:

  • Strikes
  • Lockouts
  • War
  • Terrorism
  • Pandemics
  • Epidemics
  • Fire
  • Flooding
  • Cyberattacks
  • Natural disasters
  • Energy shortages
  • Transportation disruption
  • Supplier failure
  • Government orders
  • Import or export restrictions

The delivery or performance period will be extended for the duration of the impediment.

45. Customer Default

If a business customer fails to meet its payment obligations, Maxigastro may:

  • Suspend further deliveries
  • Terminate the agreement
  • Claim compensation
  • Charge default interest
  • Recover permitted collection costs

46. Retention of Title

All goods supplied to business customers remain the property of Maxigastro until the full purchase price, interest, fees and other applicable costs have been paid.

47. Technical Support

Technical support is provided in accordance with Maxigastro’s applicable support procedures.

Telephone or email support does not guarantee that a fault can be resolved without inspection or a service visit.

Any service visit, labour or travel costs are paid by the business customer unless otherwise agreed in writing.

General Provisions

48. Late Payment

In the event of late payment, Maxigastro may charge interest and fees in accordance with applicable law.

For business purchases, default interest will be calculated in accordance with Danish law unless otherwise agreed in writing.

Maxigastro may refer an unpaid debt for collection if payment is not made by the applicable due date.

Collection costs are payable by the customer to the extent permitted by law.

49. Product Liability

Maxigastro accepts product liability to the extent required by mandatory applicable law.

Maxigastro excludes liability beyond the liability that cannot legally be excluded.

For business purchases, Maxigastro is not liable for indirect loss, business interruption, lost profit or consequential damage except where such liability cannot legally be excluded.

50. Intellectual Property Rights

All website content, including but not limited to:

  • Images
  • Product texts
  • Graphics
  • Logos
  • Designs
  • Videos
  • Databases
  • Product descriptions
  • Software
  • Source code

is owned by Maxigastro, MaxiGroup or their suppliers and is protected by applicable copyright and intellectual property laws.

The content may not be copied, reproduced, published, distributed or used commercially without prior written permission.

51. Personal Data

When a customer uses the website or purchases from Maxigastro, personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation.

Further information is available in the Maxigastro Privacy Policy.

52. Cookies

Maxigastro uses cookies to:

  • Ensure that the website functions correctly
  • Improve the user experience
  • Measure website performance
  • Produce statistics
  • Support relevant marketing activities

Customers can manage or withdraw cookie consent through the cookie settings available on the website.

53. Disclaimer

Subject to mandatory law, Maxigastro is not liable for loss or damage caused by:

  • Incorrect use of the product
  • Inadequate maintenance
  • Installation contrary to the manufacturer’s instructions
  • Modifications made by the customer
  • Actions or omissions of third parties
  • Circumstances outside Maxigastro’s reasonable control

54. Amendments to These Terms

Maxigastro may amend these General Terms and Conditions from time to time.

The conditions in effect when the order is placed will apply to that order.

The latest version will be available on the Maxigastro website.

55. Governing Law

Agreements between Maxigastro and its customers are governed by Danish law.

For consumers, this choice of law does not deprive them of mandatory consumer protection rights applicable in the country where they habitually reside.

56. Jurisdiction

Consumers

Consumer disputes will be determined in accordance with the mandatory jurisdiction rules applicable to the individual consumer.

Business Customers

Any dispute between Maxigastro and a business customer will be subject to Danish law and brought before the District Court of Roskilde, Denmark, as the court of first instance, unless Maxigastro chooses another competent court.

57. Consumer Complaint Options

Consumers should first contact Maxigastro directly regarding any complaint.
