2. Scope

These Terms apply exclusively to business customers (B2B).
By placing an order, the customer confirms that the purchase is made for professional use only.

Consumer protection rules do not apply.


3. Ordering

Orders are placed via the website.
An order confirmation is sent by email.

By completing an order, the customer accepts these Terms in full.


4. Payment

  • Payment is made via secure encrypted payment
  • Card details are not stored
  • Special-order items may be charged upon supplier dispatch
  • Backorders are treated as prepaid orders

Retention of title:
Goods remain the property of Maxigastro until fully paid.


5. Order Finality

Orders cannot be cancelled after confirmation.
Refused deliveries are treated as returns.


6. Prices & Reservations

Maxigastro reserves the right to:

  • correct pricing or system errors
  • cancel orders due to stock issues
  • adjust prices due to supplier or cost changes

7. Delivery

Products are delivered by logistics partners to the provided address.

Unless otherwise stated, delivery is made with free freight to mainland delivery points and bridge-connected islands within Maxigastro’s delivery area.

Additional charges may apply for:

  • islands
  • remote areas
  • restricted access

Delivery times are indicative only.
Delays do not entitle cancellation.

Failed delivery:

If delivery fails due to customer:

  • re-delivery fee: €60

Tracking and pre-calls are not guaranteed.


8. Inspection & Transport Damage

Goods must be inspected immediately upon delivery.

Visible damage:

  • Must be noted on delivery document
  • Otherwise accepted as OK

Hidden damage:

  • Must be reported within 24 hours

9. Risk

Risk transfers upon delivery.


10. Installation

Products must be installed by a qualified technician.
Incorrect installation voids warranty.


11. Substitution

Equivalent products may be offered if unavailable
(subject to approval)


12. Warranty

Standard:

  • 12 months commercial warranty

Covers:

  • manufacturing defects
  • material defects

Covers:

  • spare parts only

Does NOT cover:

  • labour
  • travel
  • installation
  • wear and tear
  • misuse
  • limescale
  • power issues

13. Warranty Exceptions

  • Maxima products: 6 months parts warranty
  • Ice machines under €2,700: 3 months parts warranty
  • Used goods: no warranty

No warranty on wear parts:

  • seals
  • blades
  • gaskets
  • lids

14. Service

  • Repairs via approved technicians
  • No loan equipment provided

15. Limitation of Liability

Maxigastro is not liable for:

  • loss of profit
  • operational downtime
  • food loss
  • indirect damages

Total liability limited to:

16. Returns

Return period:

  • 14 days (voluntary B2B policy)

Conditions:

  • unused
  • original packaging
  • resaleable condition

Fees:

  • Restocking fee: 15% (min. €70)

Return freight:

  • Up to 30 kg: €70
  • 30–50 kg: €170
  • 50–100 kg: €240
  • 100–200 kg: €310
  • 200+ kg: €440
  • Extractor hoods (100 cm+): €170

Extra charges apply for islands.


17. Non-returnable Goods

  • custom products
  • special-order items
  • spare parts
  • refrigeration products
  • food-contact items

18. Incorrect Deliveries

Must be reported immediately and within 14 days.


19. Service Agreements

Includes:

  • up to 12 hours/year labour
  • spare parts

Extra:

  • additional time billed
  • no-fault visits billed

Customer must:

  • clean
  • descale
  • maintain equipment

Water / limescale:

Damage due to lack of descaling:
👉 NOT covered


Fixed agreements:

  • Cannot be terminated during term (up to 3 years)

20. Cold & Freezer Rooms (Tefcold)

Installation:

Only physical installation included
(no configuration)


Electrical:

Customer responsible


Ventilation:

Required – otherwise no warranty


Floor (freezer rooms):

Customer responsible


Warranty:

  • 12 months parts only

  • Base fee: €170
  • Distance: €1/km

21. Kickback Agreements

  • Only valid while active
  • May be cancelled if business stops
  • May be recalculated retroactively

22. Force Majeure

No liability for:

  • supplier issues
  • transport delays
  • external events

23. Governing Law

Danish law applies
Disputes handled in Denmark


24. Severability

Invalid clauses do not affect the rest

25. Maxigastro VIP Membership

The Maxigastro VIP Membership is a subscription-based membership program providing access to exclusive VIP pricing, campaigns, discounts, giveaways, and member benefits.

The VIP Membership has a minimum binding period of 6 months from the date of activation.

After the binding period, the membership may be terminated by either party with 1 month’s written notice to the end of a calendar month.

Maxigastro reserves the right to modify, suspend, or terminate VIP benefits, campaigns, or membership conditions at any time.

Any misuse of the VIP Membership, including resale abuse, fraudulent activity, or violation of these terms, may result in immediate termination of the membership without refund.
